Oil rises as 'cliff' deadline approaches

NEW YORK (AP) ? Oil prices rose Monday with hopes that U.S. political leaders are getting closer to avoiding the "fiscal cliff" just hours before the deadline.

Negotiators for the White House and congressional Republicans in Congress, working against a midnight deadline, narrowed their differences Monday on legislation to avert across-the-board tax increases and spending cuts set to trigger on Tuesday.

But Republicans and Democrats remain divided, and it appears likely that financial markets will start 2013 without a clear picture of the budget policy of the U.S. economy ? the world's largest.

In afternoon trading benchmark oil rose 67 cents to $91.47 per barrel in New York. Oil has wavered in recent weeks along with the ups and downs of the budget negotiations. Through Friday oil had gained about 2 percent this month. Failure to reach a deal could eventually send the U.S. into another recession, which would drive down demand for energy.

Brent crude, used to price international varieties of oil, rose 35 cents to $110.97 a barrel.

The national average for gasoline hit $3.29 per gallon, well under the average of nearly $3.40 a month ago but 2 cents higher than a year ago.

In other energy futures trading:

Natural gas fell 11 cents, or 3.3 percent, to $3.37 per 1,000 cubic feet.

Wholesale gasoline rose 1 cent to $2.77 a gallon.

Heating oil gained a penny to $3.03 a gallon.

Apple drops patent claim against Samsung Galaxy S3 Mini

The Samsung Galaxy S3 Mini will not be involved in the next round of the never-ending Apple vs Samsung patent war.

The little brother of the flagship Galaxy S3 had been named alongside a host of Samsung devices which, according to Cupertino, infringe Apple's intellectual property.

The warring companies had been asked to present their lists of disputed devices as they gear up for a second trial in California, scheduled to begin in March 2014.

As the Galaxy S3 Mini is not being sold in the United States, Apple has sportingly agreed to strike it from the list.

Round two

However, it's not as if Samsung will be doing cartwheels about the news. Apple's list still includes the Galaxy S3, Galaxy Note 2, Galaxy Tab 8.9, Galaxy Tab 2 10.1 and Rugby Pro devices.

Apple also reserves the right to reinsert the S3 Mini if Samsung decides to launch it Stateside.

The second trial, which follows Apple's crushing victory this summer, will also hear Samsung's claims about the iPhone 5.

Pistons Heat Score: Detroit Tops Miami 109-99

AUBURN HILLS, Mich. -- LeBron James and the short-handed Heat were no match for Detroit's brilliant bench.

Will Bynum had 25 points and 10 assists, leading another spirited performance by the Pistons' reserves, and Detroit beat Miami 109-99 on Friday night despite 35 points by James.

Miami was without Dwyane Wade, suspended for a game by the NBA for flailing his leg and making contact with a Charlotte player Wednesday.

The Detroit reserves, who scored 85 points in a loss to Atlanta on Wednesday, contributed 64 this time. Charlie Villanueva had 18 points and Austin Daye added 11, helping the Pistons snap Miami's six-game winning streak.

"Their bench came in and turned it up about 17 notches. We let them get into a comfort zone in the second quarter, and after that, they were making all kinds of contested shots," James said. "It's hard to make any kind of run when a team keeps doing that to you."

The Heat scored the game's first 10 points and led by 15 after one quarter, but the momentum shifted for good when the Pistons outscored Miami 41-20 in the second.

Chris Bosh had 28 points for the Heat.

Miami had cut a 17-point deficit to four early in the fourth, but Detroit's reserves steadied themselves. Rookie big man Andre Drummond scored inside, Villanueva scored after a turnover by James, and a 3-pointer by Bynum pushed the lead back to double digits at 88-77.

"That little split of doubt that you can have ? it's a turnover, it's a missed shot, it's a bad play," Bynum said. "You just have to be aggressive and confident."

That's rarely a problem for Bynum, who looks out of control at times but can lift his team with his energy. He's played in only 22 of Detroit's 32 games this season, but he scored 31 points Wednesday and followed it up with another remarkable performance against the Heat.

"Will kind of got squeezed in the rotation," Pistons coach Lawrence Frank said. "Had several DNPs, stayed the course, and he deserves all the credit."

Detroit led 95-84 after Villanueva corralled a wild pass from Bynum and made a 3-pointer. Daye added a dunk in transition off a slick drop pass from Bynum for a 101-90 lead.

Bynum scored 13 points in the fourth quarter.

"He was amazing," James said. "He controlled the game with his motor and his offense. He was hitting everything and he was getting everyone else involved. We couldn't do anything with him."

The Pistons shot 58 percent from the field to Miami's 51. The Heat had been 31-0 since the beginning of last season when shooting at least 50 percent.

The Heat said before the game they didn't agree with Wade's suspension for making contact with Charlotte's Ramon Sessions earlier in the week.

"That's no excuse. We still had enough," Heat coach Erik Spoelstra said. "Obviously, we're a different team with Dwyane, but we have enough depth that we should be able to overcome missing one guy for a night."

Miami breezed through the first quarter, taking a 10-0 lead and eventually making 11 of its first 14 shots. It was 32-17 after one, but the game turned almost immediately.

Detroit's bench was again outstanding. The Pistons scored the first 14 points of the second and finally took a 41-39 lead on Villanueva's 3-pointer.

The bench ? specifically Villanueva, Bynum, Drummond and Daye ? scored 36 of Detroit's 41 points in the quarter, and the Pistons went into halftime with a 58-52 lead.

And that was only the beginning. Miami didn't start the third quarter any better than the second, allowing nine straight points. Greg Monroe's basket made it 76-59, and although the Heat increased the pressure defensively, they didn't always get the results they wanted.

After Shane Battier and James made consecutive 3-pointers to pull Miami within nine, James thought he'd knocked the ball away from Jason Maxiell cleanly near midcourt. But a foul was called and Maxiell made one of two free throws to make it 79-69.

It was 81-71 after three.

NOTES: Udonis Haslem is now Miami's career leader with 620 games played, snapping a tie with Wade because of the suspension. Haslem appeared to hurt his right shoulder early on when landing hard after an acrobatic block on Kyle Singler, but he was able to play on. ... Drummond had 10 points and 10 rebounds. ... Starbucks to Congress: 'Come together' on fiscal cliff

Starbucks Corp will use its ubiquitous coffee cups to tell U.S. lawmakers to come up with a deal to avoid going over the "fiscal cliff" and triggering automatic tax hikes and spending cuts.?

Chief Executive Howard Schultz is urging workers in Starbucks' roughly 120 Washington-area shops to write "come together" on customers' cups on Thursday and Friday, as U.S. President Barack Obama and lawmakers return to work and attempt to revive fiscal cliff negotiations that collapsed before the Christmas holiday.?

Starbucks' cup campaign aims to send a message to sharply divided politicians and serve as a rallying cry for the public in the days leading up to lawmakers' January 1 deadline to deliver a plan to avert harsh across-the-board government spending reductions and tax increases that could send the United States back into recession.?

"We're paying attention, we're greatly disappointed in what's going on and we deserve better," Schultz told Reuters in a telephone interview.?

The CEO said he has joined a growing list of high-powered business leaders, politicians and financial experts in endorsing the Campaign to Fix the Debt, (www.fixthedebt.org) a well-funded nonpartisan group that is leaning on lawmakers to put the United States' financial house in order.?

Starbucks plans to amplify its "come together" message via new and old media, including Twitter and Facebook posts, coverage on AOL's local news websites and advertisements in The Washington Post and The New York Times.?

"If (talks) do not progress, we will make this much bigger," Schultz said of the messaging campaign.?

Schultz is no stranger to using the world's biggest coffee chain as a platform to advocate for more political cooperation in Washington.?

During the debt ceiling debate in August 2011, he made a splash by calling for a boycott of political contributions to U.S. lawmakers until they struck a fair and bipartisan deal on the country's debt, revenue and spending.?

"We are facing such dysfunction, irresponsibility and lack of leadership" less than two years after the debt ceiling crisis, Schultz said.?

Washington narrowly avoided a U.S. government default, but not before down-to-the-wire wrangling prompted the country's first-ever debt rating downgrade.?

"There is something so wrong that we can be here again and not have the ability to put party aside for the betterment of the country," said Schultz. "We have the same language and rhetoric. Unfortunately we aren't learning much."?

New York City Crime Rates Are Up - Business Insider

New York City's overall crime rate in 2012 is on track to go up for the first time in two decades, largely because thieves are stealing so many Apple products, The Wall Street Journal reports.

Grand larceny was up 9 percent, a spike officials attributed to theft of personal electronic devices like Apple phones, according to the Journal.

Overall crime was up 3 percent.

If Apple thefts had not gone up in 2012, "we would be experiencing a slight decline in crime citywide," the NYPD's top spokesman Paul Browne told the Journal.

The NYPD seems to be taking steps to tackle smartphone theft, though.

After the new iPhone went on sale in September, the NYPD put officers in 21 stores across the city to help consumers register their phones so cops could track them down if they were stolen, Bloomberg reported.

At the time, the NYPD noted that between Jan. 1 and Sept. 30, more 11,447 Apple products had been stolen in the city ? a 40 percent increase since the same period the prior year, Bloomberg reported.

Browne told Bloomberg in an email that Apple products were a "magnet for crime."

Netflix suffers Christmas Eve outage, points to Amazon

NEW YORK (Reuters) - An outage at one of Amazon's Web service centers hit users of Netflix Inc.'s streaming video service on Christmas Eve and was not fully resolved until Christmas day, a spokesman for the movie rental company said on Tuesday.?

The outage impacted Netflix subscribers across Canada, Latin America and the United States, and affected various devices that enable users to stream movies and television shows from home, Netflix spokesman Joris Evers said. Such devices range from gaming consoles such as Nintendo Wii and PlayStation 3 to Blu-ray players.?

Evers said that the issue was the result of an outage at an Amazon Web Services' cloud computing center in Virginia, and started at about 12:30 p.m. PST (2030 GMT) on Monday and was fully restored Tuesday morning, although streaming was available for most users late on Monday.?

"We are investigating exactly what happened and how it could have been prevented," Evers said.?

"We are happy that people opening gifts of Netflix or Netflix-capable devices can watch TV shows and movies and apologize for any inconvenience caused last night," he added.

An outage at Amazon Web Services, or AWS, knocked out such sites as Reddit and Foursquare in April of last year.?

Amazon Web Services was not immediately available for comment. Evers, the Netflix spokesman, declined to comment on the company's contracts with Amazon.

miR-205 overexpression can be responsible for breast cancer ...

Over the past couple of years research into miRNAs has become increasingly diversified and attracted a great number of research articles across genetics and medicine. This should hardly come as a surprise to any scientist in the field, especially since it has become clear that miRNAs, a recently discovered class of non-coding RNAS, are represented in nearly all cellular functions and molecular pathways.

A growing list of reports demonstrates that microRNAs play a critical role in cancer initiation and progression, and that miRNA alterations are ubiquitous in human cancers. In fact, several studies have shown that miRNAs can act either as tumor suppressors or as oncogenes, and that measurement of miRNA expression in malignancies may have diagnostic implications or otherwise lead to novel treatments of breast cancer.

In the article "Mir-205 modulates acinar size and morphology of transformed breast epithelial cells" which will be released later this week in OncomiRs, molecular biologists from CEA Saclay and Universit? Paris-Sud, led by Prof. Annick Harel-Bellan, studied the microRNAs expression potentially responsible for the abnormal acini formation of breast cancer cells. They observed that the overexpression of the miR-205 influences the morphology of acini, linking this miRNA to breast epithelial cell transformation.

A genome-wide microRNA expression screen comparing non-transformed and tumorigenic MCF10A cell lines identified miR-205 as a potential modifier of acinus size. Forced expression of miR-205 in non-transformed MCF10A cells increased the size of acini, whereas miR-205 antisense oligonucleotides restored a normal morphology. MiR-205 did not modify cell proliferation, but rather inhibited cell death by apoptosis. Moreover, miR-205 targets ZEB1, an inhibitor of E-cadherin. Downregulating E-cadherin restored normal acinar morphology in miR-205 expressing cells, consistent with E-cadherin being involved in the miR-205-dependent acini phenotype.

The researchers further examined critical cellular formation in breast cancer. It has been demonstrated that normal breast epithelial cells form highly organized multi-cellular structures - the breast lobules, terminating in acinar structures called alveoli, which can be mimicked in vitro in three-dimensional (3D) cultures. Moreover, breast epithelial cells self-organize to form "acini". The size and morphology of acini is highly dependent on the degree of cancerous transformation of breast epithelial cells. Transformed cell lines form larger acini than normal cells, and cancer cells do not form normal acini, but instead form much larger aggregates of cells with no well-defined lumen.

Commenting on the research results, Prof. Annick Harel-Bellan notes: ' miR-205 is definitely not a simple tumor-suppressor miRNA in breast as previously believed, but it can be overexpressed in transformed cells and can be responsible for the abnormally large morphology of acini.'

The research highlights the complexity of miR-205 function in breast epithelial cells: miR-205 can act not only as a tumor suppressor, as formerly proposed, but also as an oncogene that favors cell proliferation or represses cell death. "Consequently, the use of miR-205 as a curative miRNA in cancer, as previously suggested by others, should be approached with great caution" observes Harel-Bellan in her article. Without doubt, continuous efforts to identify and describe miRNAs will provide novel insights into breast cancer biology, and will eventually arrange for a new molecular target for alternative treatments.

When I was in private practice, the biggest, ugliest bill reductions occurred almost uniformly in cases where a whole bunch of aggregated time entries, all several months old, were bundled together. When I shifted my career and became a client, if I received such a bill, there was virtually no chance I would have any kind of detailed recollection of the work involved, let alone whether the time spent was reasonable or not.

Worse yet, when I received such a bill and was in a position where I reported to a CFO, I couldn?t even approve it myself. I had to get ?sign off? on a bill like that to get it paid. Try getting a prickly CFO to approve a bill that?s several months old when that CFO has (a) already costed-out the matter to which it relates and (b) already reported those results to his CEO and the Board of Directors. Good luck with that.

Faced with the choice of going to bat for your outside counsel for full payment on a bill like that or recommending approval with a big discount, you can guess which would happen. It took awhile, but finally my friends in private practice started believing me when I told them that, contrary to what they might think, it?s far easier to get bills paid on time ? regardless of how big they are ? when they?re sent regularly and on-time. It?s just a corporate fact of life.

Rule #1: The longer you wait to send out the bill, the more likely you?re in for a haircut and the bigger that haircut is likely to be.

D.C., Maryland, Virginia Will All Be Represented In Inaugural Parade

A Ballou Majestic Marching Knight performs in 2010 at Union Station. The D.C. high school's band will perform in the inaugural parade for President Obama in January.

D.C., Virginia and Maryland will all be represented in next month's inaugural parade. Washington's Ballou Senior High School Majestic Marching Knights will perform, as will The University of Maryland Marching Band and the Virginia Military Institute. VMI is a traditional performer in inaugural parades.

The Presidential Inaugural Committee began sending out invitations Tuesday to participants chosen to march behind President Obama from his swearing in at the Capitol to the White House on Jan. 21, 2013.

Others to be represented in next month's march include Military Spouses of Michigan, the Lesbian and Gay Band Association of St. Louis, Chicago's South Shore Drill Team and marching bands from a high school in Little Rock, Ark. and Miami University of Ohio.

Heavy snow falling in Washington mountains

SEATTLE (AP) -- Forecasters say the latest storm moving across Washington will leave up to 2 feet of new snow in the Cascades by Thursday morning.

The National Weather Service says the lowland snow showers in parts of Western Washington on Wednesday morning will turn to rain with high winds on the coast and northwest interior until Wednesday evening.

Forecasters say heavy snow will fall in the mountains through Wednesday night, making driving through the highway passes difficult.

Heavy snow also is forecast on the east slopes of the Cascades and northeast Washington. The Weather Service says 6 to 14 inches could fall from Wenatchee north, 3 to 5 inches in the Spokane-area and 1 to 2 inches around Moses Lake.

Grandparenting: Time's have changed | HaltonParents

This is the last in our series about grandparenting

I am one of the lucky ones who has the support of two sets of grandparents to help raise my 2 kids: 2 nanas, 1 papa and 1 granddad.? Whether it is to watch them on a PD day, or run them to hockey, they are always willing to help out (even to take them for a sleep over).?? This is the kind of help that many parents with young children dream of!

When I was budgeting for all the supplies I needed to purchase for my kids, I always had to think of getting ?a spare? for those times my kids were with their grandparents.? We forget that most of the ?equipment? we have now, was not around when we were growing up.

I was reminded of this the last time my dad took my son to hockey an

d I had to say ?don?t forget the booster seat?.? Booster seat???? I wasn?t in a booster seat when I was 7 years old.? In fact, the car my parents had may not even have had seat belts in the back seat!

As parents, we take such care in selecting the right crib, stroller and car seat.?? We follow safe sleep recommendations and do everything we can think of to keep our kids safe.? This is just as important when they are over at nana and granddad?s house.

Grandparents may need some encouragement to make their homes as safe for your little ones.? For example, remove some of their plants or decorations that may be within reach and use gates to block off rooms you don?t want children in and stairways if appropriate.? Falls are the leading cause of childhood injuries in the home and account for more than half the injuries.

Also, don?t forget about medications that may be in the home.? About 20% of child poisonings involve grandparents? drugs.? This can also apply when they come to your house for a visit.? Did you know how many medications are in nana?s purse???? One tip is to hang up nana?s purse with her jacket in the closet, out of reach of children.

Remember, our parents made decisions on how to care for us and what products to use based on the information they had at the time.? They didn?t do anything ?wrong?.? As new research comes out, we need to be sure to have a conversation with grandparents and anyone else who cares for your children.? Share your concerns related to safety and how you can work together to ensure the children are safe as much as possible.? Offer to help with car seat installation, childproofing, or pack and play set up. Take a few extra steps to keep your kids safe and you can be sure to relax when they are over at nana?s and granddad?s for a sleep over (and maybe even sleep in)!!!

WASHINGTON (AP) ? An independent review board on Tuesday presented to Congress its report on the Sept. 11 attack in Libya that killed a U.S. ambassador and three other Americans, findings the Obama administration hopes will bolster its assertion that diplomats took all reasonable measures to anticipate and respond to the violence, and end months of finger-pointing and recriminations over whether the deaths could have been avoided.

Diplomats and intelligence officers alike have spoken about the rising risk in Benghazi and growing debate over how to improve security before the attack, set against Ambassadors Chris Stevens' decision to keep the Benghazi diplomatic post open and even visit there on Sept. 11.

Late that evening, militants overran the lightly defended U.S. Consulate, setting fire to it and ultimately killing Stevens and information specialist Sean Smith. Militants later fired mortars at the CIA safe house where survivors had taken refuge, killing Americans Glen Doherty and Tyrone Woods, both former Navy SEALs working for the CIA who had come to help rescue the diplomats.

Retired Ambassador Thomas Pickering and former Chairman of the Joint Chiefs Adm. Mike Mullen led the independent review, studying cables, video and intelligence and interviewing some survivors. Their review will also include their recommendations on how to keep it from happening again.

The classified section of their report was sent to Capitol Hill on Tuesday afternoon, a State Department official said. As it was being transmitted, the department began to implement its recommendations, with a team of senior diplomats convening to look at how to execute them.

An unclassified summary of the report is expected to be made public on Wednesday. On Thursday, the State Department's two deputy secretaries will testify in open sessions before House Foreign Affairs Committee and Senate Foreign Relations Committee.

Secretary of State Hillary Rodham Clinton was to have appeared at Thursday's hearing but cancelled after fainting and sustaining a concussion last week while recovering from a stomach virus that dehydrated her. Clinton is under doctors' orders to rest.

The secretary of state is required by law to convene an Accountability Review Board when U.S. officials are killed overseas in the line of duty. The secretary is not, however, required to make its findings public or send classified details to lawmakers. Still, Clinton has pledged to share as much detail as possible.

ARB inquiries are designed to look at security procedures before and during the incidents in question, and make recommendations on how they can be prevented in the future. Previous boards, notably the ones established after the 1998 bombings of the U.S. embassies in Kenya and Tanzania, have found broad fault across all branches of government, including Congress, but have not targeted individuals for blame.

The Benghazi report is widely expected to draw similar conclusions, finding that security was clearly lacking at the mission but that blame for that rests within the government bureaucracy and that there is no way to prove that additional protection could have stopped the attack.

The Benghazi incident became politically heated in the last weeks of the tight presidential campaign, with U.N. Ambassador Susan Rice criticized for saying in television interviews that the attack was part of a protest over an anti-Islamic film that had started in Cairo earlier that day. Her comments came days after the administration had intelligence pointing to a militant attack. The political fallout is not within the review board's mandate and its report is not expected to mention the controversy, except possibly in passing.

But the incident also sparked debate on the larger question of how U.S. diplomats and intelligence officers can do their jobs in unstable environments, as al-Qaida spreads across Africa, without also expanding their security. Diplomats have said that overreacting to the attack could produce what some are calling a "Benghazi effect" that would wall them off from the people they are supposed to be engaged with.

Though called a consulate, the U.S. diplomatic facility in Benghazi was so small it was only lightly staffed by a skeleton crew of diplomats and guarded by a local Libyan force. Its small size was partly because there was not yet much diplomacy to do in a city still rebuilding after the revolution that toppled Libyan strongman Moammar Gadhafi, but also because the consulate's role was in part to provide cover for the larger intelligence gathering mission in the region.

Most of the roughly two dozen Americans based in Benghazi worked for the CIA, some helping the State Department track and buy up the tens of thousands of shoulder-fired anti-aircraft missile systems known as MANPADS ? man-portable-air-defense-systems ? that have made their way from Gadhafi's arsenal to the open market, trying to keep them out of the hands of al-Qaida sympathizers throughout the region. That work included developing a network of tipsters in the port city who would watch for weapons shipments headed out of the country.

The officers were also trying to track al-Qaida's recruitment efforts in Benghazi and the small city of Darna, a couple hundred miles up the coast. Since the fall of the Gadhafi regime, Darna has become a hotbed of militant groups, such as al-Qaida in the Islamic Maghreb and the militant group Ansar al-Shariah, the lead suspect in the Benghazi attack, according to two U.S. officials briefed on the intelligence. They spoke on condition of anonymity because they were not authorized to speak publicly.

The drone that flew over Benghazi the night of the attack to give policymakers back in Washington a view of the violence had been patrolling over Darna, officials said.

Some Libyan militiamen did respond during the attack, the officials said, but not in numbers sufficient or with enough organization to repel the mob. It was the CIA rescue team that came in, guns blazing, to rescue the diplomats, while a second pick-up team of two special operations troops and CIA security personnel flew in on a hastily chartered plane from Tripoli, convinced Libyan militiamen at the airport to give them transport and rushed in to help protect the diplomats, who by then had reached a CIA safe house in the town, where they were attacked again.

The combined CIA teams held off a brief gunfire attack at the second location, so the militiamen fired mortars at the building, killing the two ex-Navy SEALs who were part of the CIA security team. The combined CIA team returned fire and the mortar fire ceased, and they were able to get the diplomats to the airport.

Microsoft Finds That People Are Finally Getting Used to Windows 8

Started using it when Developers Preview came out Upgraded to W8P the day it was available, so I was admittedly pretty familiar with it at that point... Id say it took a few days of learning to right click for choices or use the right hand side menu bar for more options. All in all I really like 8 and haven't had any major issues or regrets.. its faster than 7, does everything 7 did plus some (so no productivity issues... unless you use out of date or poorly written software that wont run on 8) and even my girlfriend loves the app store style setup and thinks its a lot more "fun" than Vista/7 (The only 2 OSs she has used heavily). I personally love the start screen and live tiles, I dont know why people are so reluctant to embrace it. If you had ever setup a personal homepage or used MSN/Yahoo/iGoogle type deals the Start screen offers that same functionality and customization. The old Start menu worked well for what it was but If you could navigate to Start > All programs > choose a program folder > select an executable than you can click a live tile, or right click choose all apps and navigate by folder/executable a la that same old start menu format of "Pinned programs (or apps as we call them now)" then Folder (Program name) & executable (Program)... As far as using desktop mode I barely notice the difference in 8 and 7, my shortcuts are there, my taskbar pins are there in the same spots they were from 7, Programs work in the same manner.. its all very familiar in that respect if you used 7 as your main OS.

I understand most people hate learning, but IMO if you arent willing to learn you are willingly giving up your right to expect to know. The biggest mistake I can see that MS has made is marketing.. Windows 8 and WindowsRT should be handled and implemented like OSx and iOS. Though I see people complaining Windows 8 is locked down, is killing gaming or cant run legacy software as if RT is the only option they have, while in reality thats wholly untrue. Anything for Win7 I have installed has worked fine, Some XP/Vista stuff not so much but why is it the burden of MS to make another vendors software works forever? If your HP camera or software doesnt work with 8 BLAME HP, NOT Microsoft. If your custom database software programmer says 8 sucks because he has to recode things, thats HIS issue not Microsoft's (Though it in-turn becomes your problem. Also, I feel this same way regarding complaints from Web Developers hating on IE because they have to do work to make it proper, like that isn't the job they are paid for.)

Over all I think its a great OS, with the features to allow PCs to stay relevant and mesh the experience were used to on Desktops/Laptops and what we expect from tablets & phones. I think average end users will be a bit slow to adopt only due to it being a latecomer, if you had all the apps you use on Android or iOS available in the Windows Store on top of the inclusion of Office on RT or Office apps for WP8 it would be hard to not jump into the Windows camp 100%.

The popularity of online shopping has been seen by many as a threat to the existence of traditional shopping. Their argument is based on the recent widespread closure of established brands like Sears and Best Buy. But can we really say that traditional shopping is dying?

In 2011, even though the U.S economy was sluggish, shopping grew by 15% over the previous year. In addition, about 35% of Americans now have smartphones which enable them to purchase goods and services over the internet and this figure is expected to rise significantly in subsequent years. In actual fact, about half of smartphone users have used their phones for one purchase or the other. On Christmas day of 2011 alone, about 6.8 million iOs and Android smartphones were activated. Top internet retailer, Amazon, recorded a whooping net sale of $48.08 billion in 2011 which represents 40.6% increase over $32.20 billion recorded in 2010. This figure is expected to rise in 2012 and subsequent years. What then is the implication of all these to physical retailing?

Since many people now decide to shop over the internet due to the benefits derivable in doing so like convenience, easy access to market, price comparison, avoidance of crowd, better prices and so on, can we really say that that the traditional way of shopping is being threatened? In my own opinion, technology will enhance the traditional method and not kill it. The popularity of video cassette recorder (VCR) in the 80?s was seen by many as a threat to movie theaters then, but today, the film industry has been strengthened by the new technology and the demand for films has increased.

Moreover, when the email became very popular, a lot people thought that the traditional postal service would die, but today, it is waxing stronger. The point I?m driving at here is that, if traditional shop owners can embrace new technology, shopping on the internet would not be a threat to them but a blessing.

If physical retailers can monitor shopping behavior through the use of Wi-Fi signals from smartphones, they would be able to compete favorably in a fast-changing world. They can use technology to measure loyalty, make better staffing decisions, improve store layouts, reduce wait times in checkout lines and so on. Online shopping has come to stay but it is not a threat to traditional shopping because many consumers still value some of its features like quality of customer service, the experience of trying and buying products, how products are displayed and so on.

Draghi: ECB bank oversight will revive confidence, lending

BRUSSELS (Reuters) - New European Central Bank powers to oversee euro zone banks will help restore confidence in the sector and revive interbank lending, its president, Mario Draghi, said on Monday.

European ministers clinched a deal last week to give the ECB powers to supervise the currency bloc's banks from March 2014, taking the first step in a new phase of integration to help underpin the euro.

"The single supervisory mechanism will contribute to restoring confidence in the banking sector across the euro area. It will help revive interbank lending and cross-border credit flows, with tangible effects for the real economy," Mario Draghi told the European Parliament's Economic and Monetary Affairs Committee.

Bank-to-bank lending has yet to recover from the onset of the global financial crisis in 2007, and many banks rely on the ECB for their liquidity needs while others hoard their cash rather than lend it on.

Although the ECB will only have automatic oversight of around 150 of the bloc's 6,000-odd banks, it will have the authority to intervene in smaller banks if there are signs of trouble.

Germany fought hard to constrain the ECB's scope so that it would not cover its savings banks.

Draghi said: "The national supervisors' role gets bigger as the banks get smaller, but all national supervisors will be subject to the single rulebook as regulated from the center. The ECB will retain power to call in any bank under its domain."

Once ECB supervision is in place, the euro zone's rescue fund - the European Stability Mechanism - will be allowed in principle to recapitalize banks directly.

For now, euro zone governments have had to shore up their banks, adding further to public debt and creating a vicious circle between weak banks and states.

"Combined with possible direct recapitalization of banks by the European Stability Mechanism and an envisaged single resolution mechanism, the single supervisory mechanism will go a long way towards breaking the vicious feedback loops between sovereigns and banks," Draghi said.

More profound mechanisms such as a resolution structure to wind up failing banks and a deposit guarantee fund are a long way from being implemented. Draghi said the ideal scenario would have had cross-border supervision and a resolution fund set up in tandem.

Both Draghi and his ECB Governing Council colleague Luc Coene dismissed critics who have questioned whether the central bank can hold its independent line on monetary policy while also looking out for the welfare of banks.

"At the end of the day the Governing Council will be accountable for the efficient conduct of both policies," Coene said in a speech in Brussels.

Draghi also said the medium-term outlook for the euro zone economy remained "challenging".

At its policy meeting earlier this month, the ECB forecast a bleak 2013 for the euro zone economy, which it said would probably shrink again. It left the door open to a further reduction in interest rates - already at a record low 0.75 percent - in the early months of next year.

"We expect domestic weakness to extend into next year with a very gradual recovery in the second half of the year," Draghi said.

The big question for the ECB in the early months of next year will be whether Spain asks for help from the ESM, after which the central bank could activate its bond-buying program, the promise of which has gone a long way to calming the furor surrounding the euro zone.

Draghi said it was not up to the ECB to encourage governments to trigger the program.

School shooting compels entertainment changes

NEW YORK (AP) ? The Connecticut school shooting rampage compelled Hollywood to air disclaimers before violent television shows, swap some programs for others, cancel film openings and present somber specials on daytime TV shows that are usually more focused on entertainment.

The responses came in addition to news specials on Friday's killing of 27 people, most of them school children, in Newtown, Conn., by a gunman who later took his own life.

Showtime gave its viewers a special warning Sunday before the season finales of the thriller series "Homeland," and "Dexter," a series about a serial killer.

"In light of the tragedy that has occurred in Connecticut, the following program contains images that may be disturbing," said the disclaimer before both programs.

Another cable network, HBO, postponed airings of the 2012 crime thriller "Contraband" over the weekend. The film with Mark Wahlberg and Kate Beckinsale was replaced by airings of "Crazy, Stupid Love" and the remake of "Arthur," the network said.

The Film Society of Lincoln Center in New York canceled Monday's screening of Tom Cruise's violent new movie, "Jack Reacher," that was to include a conversation with the actor. A scheduled premiere of the movie in Pittsburgh had also been postponed over the weekend.

In Los Angeles, the Weinstein Co. canceled Tuesday's planned premiere of the violent movie "Django Unchained."

The TLC network postponed a Dec. 27 special, "Best Funeral Ever," about a colorful Dallas funeral home. The show, considered a pilot for a potential series, will instead air during the first week of January.

In one of the odder substitutions, NBC pulled a Blake Shelton holiday special at the last minute Friday and replaced it with one starring Michael Buble. That's because the Shelton special had an animated segment about a reindeer killing, which NBC would be removed from any future showings of the special.

It's a ritual for entertainment companies in the wake of national tragedies, noted Chris Ender, CBS entertainment spokesman: The network's series and promos are all looked at carefully with an eye toward whether any of them could be considered insensitive with the news still fresh in mind. CBS has made no changes other than doing two prime-time news specials, he said.

Fox on Sunday night replaced new episodes of its animated comedies "Family Guy" and "American Dad" with repeats amid worries they could be seen the wrong way. The "American Dad" episode featured a demon who punished naughty children at Christmas.

Several daytime talk shows, including "Katie," ''Dr. Oz," ''Dr. Phil," and "The Doctors," responded with shows Monday that were dedicated to Friday's shootings. That's unusual for these shows, which are usually taped much further in advance.

Katie Couric's show featured interviews with two families that had lost children in the shootings. In one interview, Couric asked the sobbing brother of one child killed, "Is there something you want people to know about your little brother?"

News reporters had been criticized in the immediate aftermath of the coverage for interviewing children who had been in the Newtown school during the shooting.

Both Couric and "Dr. Oz" featured interviews with spiritual leader Joel Osteen.

Talk show host Phil Graham, in addition to devoting his own program on the shooting, also appeared in Monday's episode of "The Doctors."

"Doctor's orders: Hug your family a little bit tighter today," said Travis Stork of "The Doctors."

"The View" invited ABC News' Chris Cuomo and forensic psychiatrist Michael Welner to talk about the incident. One of the show's co-hosts, Elisabeth Hasselbeck, asked Welner with tears in her eyes, "How can this happen?"
